Ash and Kern were driving from Lemmon to Hettinger, N.D., a southwestern North Dakota community, when the shooting occurred, court documents say. The men had been drinking together earlier that evening.

It was not improper and was not obvious error," said the court's majority opinion, written by Justice Herbert Meschke.

Ash's lawyer, David Senn of Dickinson, also argued that Vukel-ic's brief singing of a Christmas carol, "Do You Hear What I Hear," attorney general who prosecuted Ash, contended Ash shot Kern deliberately behind his left ear after FOR THE RECORD BIRTHS E3 1 smashing his Vukelic: face with the ri- Singing, fle's butt.
